PRICES Because of constantly changing market conditions, prices are subject to change without notice. Unless there has been no previous quotation made by verbal or written agreement, all orders will be invoiced at prevailing prices at time of shipment.

TERMS Our normal payment terms are Net 30 days on approved open accounts. In addition to open accounts, we accept cash, most major credit cards, and C.O.D. Shipments are F.O.B. Shipping Point unless otherwise agreed upon.

TAXES Any state, county, or city taxes will be imposed on any article unless a valid tax exemption certificate is on file with us.

QUOTATIONS Quotations, unless otherwise stated, are for immediate acceptance. Insco Distributing Inc. reserves the right to re-quote on any commodity that has fluctuated in price due to market conditions. Deliveries are approximated and contingent upon the manufacturers own ability to deliver within a specified time. We will assume no liability for losses incurred resulting from non-delivery of goods on a specified date. All quotations and agreements shall be contingent upon fire, flood, strikes, accidents, or any other causes beyond our control. Clerical and inadvertent errors are subject to correction.

RETURNED GOODS Goods cannot be returned without our authorization and must be in good, re-saleable condition(free of damages, defects, scratches, markings, etchings, etc.), and must include original packaging, literature, and accessories. Errors in shipping or goods having manufacturing defects may be returned and credit or exchange given. Unless Insco Distributing Inc. has erred, all returns must be freight prepaid and are the responsibility of the customer. When returning goods, please give complete information pertaining to the subject order. Always include a copy of your invoice or packing. Claims for discrepancies in shipment must be made within 7 days of receipt of merchandise. Customer errors in ordering cut-to-length products are non-returnable.

CANCELLATION Cancellation of orders for material, which we do not regularly carry in stock, must have factory approval before returning and may be subject to a minimum 15% re-stocking charge and freight charges.

STOCK It has always been the policy of this company to maintain a complete, adequate stock of inventory. However, there are many items which we do not show in this catalog that are available from our manufacturers. We invite all inquiries which you might have.

INVOICING Insco Distributing Inc. can invoice you using standard invoicing procedures, summary invoicing, EDI, and by credit card, including American-Express, Visa, and Mastercard.

SHIPPING Insco Distributing Inc. maintains a fleet of delivery vehicles to get your shipment to the jobsite or plant when you want it. We offer scheduled deliveries within our service areas at no charge. In addition, we can ship via UPS, Federal Express, or U.S. Postal Service delivery at published rates.

LIMITED WARRANTY

LIMITED WARRANTY All products sold are warranted by Insco Distributing Inc. only to purchasers for resale or original equipment manufacturers or for use in business operations, against defects in workmanship or materials, under normal use for one year after the date of purchase from Insco Distributing, unless otherwise stated in product listings in this catalog. Any part or parts which is determined by Insco Distributing Inc. to be defective in material or workmanship and returned to an Insco Distributing Inc. branch, as designated by Insco Distributing Inc., and returned with all shipping costs prepaid, will be, as the exclusive remedy, repaired or replaced, at Insco Distributing Inc.’s option.

WARRANTY DISCLAIMER Insco Distributing Inc. has made a diligent effort to accurately illustrate and describe the products in this catalog; however, these illustrations and descriptions are for the sole purpose of identification, and do not express or imply a warranty that the products are merchantable, or fit for a particular purpose, or that the product will conform to the exact illustrations or descriptions represented in the catalog. PROMPT DISPOSITION Insco Distributing Inc. will make a good faith effort for prompt correction or other adjustment with respect to any product that proves to be defective within the warranty period. Before returning any product, customers should write or call the Insco Distributing Inc. location from which the product was purchased, giving the date and number of the original invoice, and an accurate description of the defect. Title and risk of loss pass to the buyer on delivery to the common carrier. If product was damaged in transit, recipient must file claim with the carried.

PRODUCT LIABILITY Many cities, states and other localities have codes and regulations governing sales, construction, installation, and/or use of products for certain purposes, which may vary from those in neighboring areas. While Insco Distibuting Inc. attempts to assure that products comply with such codes, it cannot guarantee compliance, and cannot be responsible for how the product is used or installed. NO WARRANTIES TO CONSUMERS Insco Distributing Inc. makes no warranties to those defined as consumers in the Magnuson-Moss Warranty-Federal Trade Commission Improvement Act.

MANUFACTURERS WARRANTIES AND SALES LITERATURE Many of the products listed in this catalog are warranted to the final user by the manufacturer; copies of these warranties are packaged with the product by the manufacturer when purchased or are available from the manufacturer. As a value added service, Insco Distributing Inc. will obtain copies of consumer warranties from the manufacturer or other warrantor and will furnish them free of charge to customers who request them. Such requests should be mailed to Insco Distributing Inc., 12501 Network Blvd, San Antonio, Texas 78249. Requests must include the Insco Distributing Inc. order number and the manufacturer’s model number of each product for which a copy of the warranty is requested. Insco Distributing may also furnish sales brochures and other literature of the manufacturer. Insco Distributing Inc. assumes no responsibility for the content of such warranties or sales literature by performing this value added service.
